1. Who provides the App

Each App is made available by the sports club or entity whose name and brand it bears (the ‘Club’). The App is developed, published in the app stores and operated by PLUGGABLE, S.A., NIPC 517 256 770, with registered office at Edifício GNRation, Praça Conde de Agrolongo, n.º 123, 4700-312 Braga, Portugal (‘Pluggable’), on behalf of the Club.

The Club’s identification and contact details are available in the App and on the Club’s official website.

2. Acceptance

By downloading, registering in or using the App, the User accepts these Terms of Use. Users who do not agree with them should not use the App.

The processing of personal data in the App is described in the App Privacy Policy, available at www.fanofthematch.ai/app-privacy-policy.

3. Eligibility and account

The App is not intended for children under 13.

Some features require registration. The User must provide accurate information, keep the account credentials confidential and is responsible for any use of the account. Each User may only hold one account.

The User may delete the account at any time directly in the App.

4. The App and its features

The App is free of charge. It gives access to the Club’s news and content, match information, notifications and a digital fan zone with activations such as Fan of the Match, trivia, polls, MVP votes and predictors.

The features available may vary between Apps and over time, according to what each Club makes available.

5. Activations, prizes and sponsors

Each activation is governed by its own participation rules, available in the App, which prevail over these Terms of Use for that activation.

Some activations use location data to validate the User’s presence at the stadium, or use the device’s sensors. Taking part in these activations is optional.

Some activations may be promoted by, or carried out in partnership with, the Club’s sponsors and partners. Prizes are awarded under the participation rules of each activation.

6. Services of the Club and of third parties

The App may give access, through integrated web pages, to services provided directly by the Club or by service providers chosen by it, such as ticketing, membership and the online store. Purchases made in these services are contracts between the User and the Club or the relevant service provider, under their own terms and conditions. Pluggable is not a party to those contracts.

The App may also include links to third-party websites and content, which have their own terms.

7. Rules of use

The User agrees to use the App in accordance with the law and these Terms of Use and, in particular, not to:

• manipulate or attempt to manipulate the results of activations, namely by simulating location, using automated means or creating multiple accounts;
• publish content that is unlawful, offensive or discriminatory, or that infringes the rights of third parties;
• interfere with the operation or security of the App, or attempt to access areas or data without authorisation;
• copy, modify, decompile or reverse engineer the App, or use it for commercial purposes without authorisation.

In the event of a breach, the Club or Pluggable may remove content, exclude the User from activations and suspend or close the account.

8. User content

Content that the User publishes in the App, such as comments or images, is the User’s responsibility. The User grants the Club and Pluggable a free, non-exclusive licence to display that content in the App for as long as it remains published. The Club and Pluggable may moderate or remove content whenever necessary for legal, technical or security reasons, or in the event of a breach of these Terms of Use.

9. Intellectual property

The App, its software and the Fan of the Match and SPORTS X APP brands belong to Pluggable. The Club’s names, brands and content belong to the Club, and the sponsors’ brands belong to their owners. The User receives a personal, non-exclusive and non-transferable licence to use the App for its intended purpose, which does not grant any other right over these elements.

10. Availability and liability

The Club and Pluggable make every effort to keep the App available and working properly, but do not guarantee that it will be free of interruptions or errors, namely during maintenance or for reasons beyond their control.

The App may stop being available, namely if the Club stops making it available. In that case, the account and the associated data are deleted as described in the App Privacy Policy.

To the extent permitted by law and except in cases of wilful misconduct or gross negligence, neither the Club nor Pluggable is liable for damages resulting from the use of, or the inability to use, the App. Nothing in these Terms of Use limits the rights that the law grants to consumers.

11. Changes to these Terms of Use

These Terms of Use may be updated whenever necessary. Significant changes will be communicated through the App. Continuing to use the App after a change means accepting the new version.

12. Applicable law and disputes

These Terms of Use are governed by Portuguese law. Without prejudice to mandatory legal provisions, namely those protecting consumers, any disputes shall be submitted to the courts of the district of Braga. In the event of a consumer dispute, the User may resort to an alternative dispute resolution entity, such as CIAB, Centro de Informação, Mediação e Arbitragem de Consumo (www.ciab.pt).
